Coaching, Plans, Training Sessions, Personal Training & Fitness Classes
Please note: The recommendations and information on this website, blog and any other document provided by me are not medical guidelines but are for educational purposes only. You must consult your doctor prior to starting this or any other exercise programme or if you have any medical conditions or injury that can possibly worsen with physical activity does. Any exercises and dietary advice provided are not intended as a substitute for any exercise routine or treatment or dietary regimen that may have been prescribed to you by your doctor, physical therapist or dietician. Any exercise poses inherent risks and you are advised to take full responsibility for your own safety and know your limits at all times. If you experience any light-headedness, dizziness, or shortness of breath while exercising, stop the movement and consult a physician immediately. You are strongly advised to have a complete physical examination if you are sedentary, if you have high cholesterol, high blood pressure, or diabetes, if you are overweight, or if you are over 30 years old. Please discuss all nutritional changes with your doctor or a registered dietician. If your doctor or registered dietician does not recommend any of the changes or exercises, this will overrule any advice from your personal trainer. Please inform your personal trainer immediately in these instances. You are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against ChiliTri Coaching for information and advice provided. You have read and voluntarily agree to the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. ChiliTri Coaching does not accept any liability that may arise from using or downloading information from the website.
All Coaching / Personal Training / Program Design Services Disclaimers
Informed consent: The programme will be based upon your present activity/exercise levels and the goals that you wish to achieve. You will experience some feelings of exertion during each activity session and will become hot and uncomfortable at times, if your plan includes certain types of cardiovascular exercise. Your breathing and heart rate will increase as a result of these activities as would be expected from physical exercise of this type. As your fitness improves, you will participate in more vigorous levels of activity if this is part of your goal, but these will be within your capabilities. Activities will be explained and/or demonstrated either in person, video or with an exercise guide (depending on service that has been opted for) but please feel free to ask questions about anything you wish. If, at any time, you feel undue pain or excessive discomfort stop the activity and inform your trainer of your symptoms. You are free to withdraw from any activity at any time you wish. Assumption Of Risk: Any exercise programme carries with it an element of risk. The sessions will be designed to minimise the risks whilst providing an effective exercise/activity intensity. Please inform the instructor if, for any reason (such as illness or injury which might be aggravated by exercise, or eating certain foods), you should not participate in an activity. You agree that you are voluntarily participating in any physical exercise or activity, including personal training, or using any facility or equipment, you do so at your own risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in physical exercise or not. Release: You agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Trainer (and Trainer’s affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) arising out of the negligence of Trainer, whether active or passive, or any of Trainer’s affiliates, employees, agents, representatives, successors, and assigns. Acknowledgments: You are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against trainer for trainer’s negligence, or for any defective product used while receiving personal training from trainer. You have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
Medical Health / PAR-Q
If you have answered 'YES' to one or more questions on the Medical Health Form: Talk to your doctor by phone or in person before you start becoming more physically active and before you have a fitness assessment. Tell your doctor about the questionnaire and which question(s) you have answered yes to. You may be able to do any activity you want - as long as you begin slowly and build up gradually, or you may need to restrict your activities to those which are safe for you. Talk with your doctor about the kind of activity you wish to participate in and follow his/her advice. If you have answered 'NO' to all questions on the Medical Health Form: You can be reasonably sure that you an start to become more physically active and take part in a suitable exercise program. Remember - begin slowly and build up gradually. Please note: If your health changes so that subsequently you answer 'YES' to any of the above questions, inform your fitness or health professional immediately. Ask whether you should change your physical activity or exercise plan. Delay becoming more active if you feel unwell because of a temporary illness such as flu - wait until you are better.
COVID-19 POLICY 2021 bookings only
Cancellation by ChiliTri Camp due to COVID-19
If ChiliTri are forced to cancel your camp due to COVID-19 reasons we will provide a full refund provided the camp has not commenced. The cancellation will be based on the following:-
UK, Spanish, (or any country where we are running a training camp) or Home Country Government State of Emergency or Lock down Imposed, and travel to the destination of your chosen camp not being able to take place.
Home Country FCO advice against non-essential travel to to the destination of your chosen camp.
Home Country Quarantine period on either arrival in Spain (or any country where we are running a camp) or in your Home Country return destination.
Hotel Closure due to national or local advice in Spain (or any country where we are running a camp).
If by any chance additional expenses are incurred through situations outside of our control i.e. delays, accident, strike, riots, government advise, or acts of God this term includes pandemics and the like Challenge Tri Camp will not be held accountable.
Discretionary Administration Fee
ChiliTri, like most companies who work in the travel or sports related industries, have been hugely financially affected by the COVID-19 pandemic and we have done everything we can in the last 6 months to sustain the business. We ask you, our client, to consider paying an administration fee of £100 If we have to cancel your camp and refund your payment. This is not mandatory and at your own discretion. All our costs for your camp are paid in advance including, coaching costs, insurance, marketing, accommodation, flights and most are not redeemable. This discretionary payment will allow us to continue to sustain the business until we can start working with you on camp again. We are a small business, with no outside investment and this will help us to ensure the survival of the ChiliTri.
Payment
An initial deposit of 30% of the total booking paid by bank transfer is required upon booking via our web site. Once we have received your deposit and booking form, we will confirm your booking with the hotel or B&B and in turn confirm your booking with ChiliTri. Once your booking has been confirmed your deposit is non refundable and non transferable. The total balance of the trip is to be paid 10 weeks prior to your arrival, non payment of the outstanding balance at 10 weeks will result in the loss of the deposit and the booking cancelled.
Flights, transport, transfers, bike hire and personal insurance of any kind and hotel tourism tax are not included in the price of any booking. The tourism tax is to be paid at the hotel reception normally on departure, to confirm ChiliTri camp are not a package travel or a linked travel provider.
Cancellation and Changes by the Client
Cancellation must be in writing (e-mail is fine). We will contact you by email to confirm your requests. Sending request of cancellation by recorded delivery is advisable but please check before sending to which address is best. You will be liable to pay the balance of the monies in full if you do not notify ChiliTri of your intention to cancel 10 weeks prior to your arrival date with ChiliTri. Please note that if you have not made payment in line with our booking terms and conditions and you have not paid any outstanding balance due, and we are unable to contact you, your booking will be cancelled and the cancellation charges will come into effect as below. Should you wish to make any changes to your booking after it has been confirmed and reserved you are requested to advise us of your wishes. Whilst we will endeavour to assist to the best of our ability, we cannot guarantee that we will be able to meet all requests. If by any chance additional expenses are incurred through situations outside of our hands i.e. delays, accident, strike, riots or acts of God, this term includes pandemics, and the like, ChiliTri will not be held accountable.
Cancellation charges
Notifying us more than 10 weeks before departure – Loss of deposit, as per Payment paragraph all deposits are non refundable.
Notifying us less than 10 weeks before departure – Loss of deposit and total balance*
*If you have not paid the total balance then ChiliTri will seek to recover the outstanding balance together with any legal costs incurred during this process.
It is always best to contact us by phone or e-mail to discuss any items with your booking, always use your unique reference number when contacting ChiliTri. ChiliTri confirms that it is a requirement of your booking with us that travel / holiday insurance is taken out at the same time as your booking with us that covers you for any type of cancellation, and all and any types of risk.
Cancellation, Postponement or Changes by ChiliTri
Whilst rare, it could at some stage be necessary to make minor or major alterations to the booking and other details both before and after bookings have been confirmed. Although most changes would be minor ones, we reserve the right to do so but will advise you of any issues arising from such changes. If it is necessary to make a significant change before arrival, we will advise you as soon as we can. We will then offer you the following choices:-
Accepting the changed arrangements as notified to you.
Purchasing an alternative camp using the value of our booking. If your new booking is more expensive you will be required to pay the difference at the time of booking, if the booking is cheaper we will refund you the difference. When this option is selected this must be confirmed with us within 14 days of being notified of a significant change, and the alternative selected camp must be taken during the same calendar year.
If by any chance additional expenses are incurred by the client at any stage during or after booking with ChiliTri, through situations outside of our control i.e. delays, accident, strike, riots, government advise, or acts of God this term includes pandemics and the like, ChiliTri will not be held accountable.
Changes to the ChiliTri Itinerary once you have arrived on camp
Whilst rare, it could be that your camp has to be cut short due to events out side of ChiliTri control, should this happen then your camp will be regarded as delivered and a refund will not be offered. If by any chance additional expenses are incurred through situations outside of our control i.e. delays, accident, strike, riots, government advise, or acts of God this term includes pandemics and the like ChiliTri will not be held accountable.
Guest Coaches On Camp
Occasionally ChiliTri will advertise a training camp with a ‘Guest Coach’. If the ‘Guest Coach’ is unable to join us on camp for that week, whatever the reason, ChiliTri will continue to run the camp, and this will not be considered as a ‘significant change’ as described in the paragraph Cancellation, Postponement or Changes by ChiliTri Camp above. If an athlete wants to cancel their camp because the guest coach will not be on camp, the cancellation will be subject to ChiliTri’s standard cancellation terms: Cancellation and Changes by the Client as above.
Spring 2020 COVID-19 Camp Deferrals
Spring 2020 postponed camps due to COVID-19 must be taken during our Spring 2021 season which runs from 6th March to 16th May 2021. If the athlete is unable to join us on camp during this period, for whatever reason, then ChiliTri Camp will refund the camp cost less the deposit as per our standard booking terms & conditions.
Arrival
Your accommodation will be available to you from 14.30 on the day of arrival, unless you have contacted us to arrange an earlier check-in time at the time of booking.
Departure
Please vacate your room by 11:00 on the day of departure.
Conditions of carriage
ChiliTri does not organise flights, ferries, airport transfers or train travel. ChiliTri has no part in the contract between you and the airline, ferry, transfer provider car hire or train company, we are not a package travel or linked travel provider.
Damage
Any damage to the accommodation or property of ChiliTri or any third party by the client whether accidental or deliberate must be paid in full at the time of the damage.
Insurance
Clients must have a comprehensive and valid multi sports insurance policy in place when they arrive and during their stay with ChiliTri. This policy should include emergency medical care, cover for personal injury, including cover for all activities, including water activities, loss or damage to your luggage, loss or damage to equipment hired or borrowed from us or third parties, repatriation, legal expenses cover and expenses associated with cancellation or curtailment of their booking for any reason see also cancellation notes above. You should, if applicable, be in possession of an up to date EHIC card ( valid until 31st December 2020) available from your local post office or online before travelling abroad, once we leave the European Union you must also make sure your travel insurance covers you for all medical expenses and cover as detailed fully above.
It is a condition of your booking that you have travel insurance that covers multi sport activities including road cycling, running and swimming (both pool and open water) and that these documents with emergency telephone numbers are made available to ChiliTri before your arrival on camp with us it is your responsibility to prove this to us at least 14 days before your arrive on camp. To further confirm the policy must include emergency medical care, cover for personal injury, including cover for all activities, including water activities, loss or damage to your luggage, loss or damage to equipment hired or borrowed from us or third parties, repatriation, legal expenses cover and expenses associated with cancellation or curtailment of their booking for any reason what so ever.
Road Transportation and Cycling on The Road
ChiliTri does not accept responsibility for loss, damage or injury whilst using road transportation to or from camp. ChiliTri does not accept any responsibility for your road cycling equipment including your bikes and any road side or bike garage repairs are the sole responsible of the client. This includes any delay due to mechanical breakdown or traffic related incidents. Any costs incurred for collection and return to the hotel or a bike shop will be the responsibility of the client.
Risks
You should recognise the inherent risks in the activities you will be participating in and agree to accept complete responsibility for any injury, damage or loss caused by you or to you as a result of participation in those activities. You will be requested to sign a disclaimer when booking or on arrival at the hotel, which outlines your acceptance of the risks as part of participation in the activities at ChiliTri. This does not remove our legal duty of care but is simply used to highlight your acceptance of the risks inherent in the activities in which you are participating. We will also highlight these in our welcome meeting and through a waiver we ask you to sign on your arrival day.
Bicycle Protection Endorsement
As you are partaking in cycling activities it is our responsibility to inform you that protective headgear can vary from destination to destination and therefore if hiring headgear we cannot guarantee that it will be provided or will be to the same standard as those available in the UK. We strongly advice you to use your own head gear or purchase head gear that is BSEN 1078 complaint. This is stated in our Terms and Conditions and from the date the requirement has been issued (September 14th 2016) is our policy to follow – no limitations and exclusions. All helmets worn must match these safety standards.
